The actress, 60, and her ex-husband Olivier Martinez, also 60, were photographed arriving separately at the Los Angeles courthouse on Tuesday, Oct. 20, for a custody hearing over their 13-year-old son Maceo. The actress was seen entering the courtroom without her fiancé Van Hunt, who accompanied her during the first day of the hearing.
Berry, who has been accused of physically assaulting Maceo during a Sept. 26 incident, could be seen wearing a black suit over a dark checkered shirt. She added sunglasses and carried a small black bag while heading into the courtroom alongside her lawyer.
Martinez was also photographed wearing a gray button-down shirt, jeans and aviator sunglasses.

Berry and Martinez welcomed their son in 2013, filed for divorce in 2015 and finalized it in 2023 after a contentious eight-year battle. The Oscar winner also shares daughter Nahla, 18, with ex Gabriel Aubry.
In his Oct. 1 petition obtained by PEOPLE, Martinez alleged “instances of abuse over the course of the last few years” and that Berry caused him “emotional and mental distress due to physical abuse of our minor child, Maceo.”
In the filing, the French actor detailed the alleged incident on Sept. 26 in which he claims Berry “grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?’” Her fiancé Hunt was present during the alleged incident.
The filing includes alleged texts between the former couple at the time of the incident in which Berry said that Maceo “is disrespectful to me” and “I’m just money bags!” On Sept. 27, she allegedly texted Martinez, “I feel terrible about what happened last night as I know he does as well.”
Martinez has also requested sole custody of Maceo in the filing.

On Oct. 19, Maceo testified on the first day of the custody hearing, per a court order by the judge. However, his testimony was “limited to the request for an issuance of a restraining order.”
In court documents obtained by PEOPLE on Oct. 12, Martinez said that Maceo wanted to address the court “to provide his side of the story” during the upcoming custody hearings.
Then, in documents filed the next day, Berry objected to Maceo testifying, claiming that Martinez was dismissing statements from other key eyewitnesses, including Hunt and Nahla, who previously wrote in court docs that she had never seen her mom “physically abuse Maceo in any way.”
Berry went on to caution the court against placing “substantial weight” on the testimony of her teenage son, who she described as being a “coached and manipulated child.”
