Halle Berry Learns Her Fate in Court After Ex Olivier Martinez’s Restraining Order Request Over Abuse Claims

The judge overseeing Halle Berry and ex Olivier Martinez's bitter custody case has reached a decision ... and it looks like Halle got her way in that the domestic violence restraining order was dissolved, but she lost big on the issue of custody.

On Thursday, Los Angeles Superior Court Judge Shelley Kaufman tossed out Martinez’s request for a domestic violence restraining order protecting himself and their 13-year-old son, Maceo, and lifted the temporary restrictions imposed on the actress.

The ruling comes as a big win for Berry, who has accused Martinez of escalating their custody dispute by alleging she abused their teenager.

“We are extremely pleased that the Court has dissolved the TRO,” Berry’s attorney, Marina Beck, told Page Six exclusively. “As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family.”

A source added, “This is a huge win for Halle.”

Martinez’s attorney did not immediately respond to our request for comment.

Page Six can also confirm that the former couple’s custody arrangement from the previously granted temporary restraining order will remain in place until the matter is addressed at a future hearing.

Kaufman’s decision follows nearly four hours of sealed testimony from Maceo on Oct. 19, the first day of the hearing, as his therapist and a school official also took the stand.

Berry and Martinez testified, too, with the latter storming out of the courtroom and using profanity as he appeared agitated and upset by the closed-door discussions.

Berry’s 18-year-old daughter, Nahla Aubry, and her fiancé, Van Hunt, also testified in a closed courtroom over the course of the nine-day proceeding.

Aubry previously defended her mother in a court declaration, stating she was “shocked” by the accusations and had never witnessed her behave aggressively toward her half-brother.

Martinez, 60, accused Berry, also 60, of physically abusing Maceo — including choking him during a Sept. 26 altercation — in a domestic violence restraining order request. He also asked for sole legal and physical custody.

Kaufman granted Martinez’s request for a temporary protective order on Oct. 1.

Berry, meanwhile, has consistently denied the allegations detailed in the filing.

“There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son, Maceo — misconduct for which Mr. Martinez has already been legally sanctioned,” her attorney, Marina Beck, previously told Page Six.

The “Monster’s Ball” star had asked the judge to deny Martinez’s restraining order request and lift the temporary restrictions.

She accused the French actor of escalating their custody dispute and interfering with their son’s educational and therapeutic needs.

Berry sought sole legal custody of Maceo, which would give her greater authority over decisions involving his health, education and welfare, while proposing that the former couple continue an alternating-week living arrangement.

Additionally, she asked to expand her existing tie-breaking authority to cover decisions involving the teen’s health, education and welfare.

The Oscar winner and Martinez were married from July 2013 until their separation two years later. They were declared legally single in December 2016 before finalizing their divorce in August 2023.

UPDATE: Olivier's lawyer, Patrick Baghdaserians, tells TMZ ... Olivier has primary physical custody of their 13-year-old son, Maceo. Halle and Oliver had joint custody in the past, and Baghdaserians tells TMZ Halle's lawyers had asked to restore 50/50 custody, but the judge rejected that. We're told, however, that the judge will re-consider custody issues in November, so next week it's back on the table.

TMZ reports that the judge also ruled Halle could no longer have overnight visits with Maceo. We're told Martinez asked to restrict Halle's custody during holidays, and that was denied.

Baghdaserians says the decision to give Martinez primary physical custody is a "huge victory," after the judge heard evidence of the way both his client and Halle parent Maceo.

Halle's rep says she still has joint legal custody, and holds the tiebreaker in the event the 2 are at loggerheads.

Olivier had claimed Halle choked Maceo -- who later gave a deposition behind closed doors at court with both Halle and Olivier ordered out of the courtroom.

Halle -- who denied the allegations -- had tried to stop Maceo from taking the stand ... claiming that Olivier had coached him. In the end, Maceo did take the stand in a closed hearing.
