Justin Timberlake slammed after lawyer says he 'was not intoxicated' during DWI arrest
During the hearing, it was revealed that there is a subpoena out to the American Hotel — where Timberlake was hanging out with friends before his arrest.
It is "complying" with the case, but Irace expected the prosecution to be further along in the discovery process.
Timberlake did not appear in court, as he is currently overseas for his Forget Tomorrow World Tour.
The next hearing is scheduled for Sept. 13, but Timberlake is not be required to appear in person.
After Friday's hearing, Timberlake's attorney Burke briefly addressed the media outside the courthouse to say: "No comment today," before adding that it was "strictly" a "very procedural day."
During an August 2 hearing, the Cry Me a River singer appeared in court virtually from Antwerp, Belgium, to plead not guilty to a revised misdemeanor charge of driving drunk.
Timberlake looked somber on the video call and later had his driving privileges in New York revoked by the judge.
Burke claimed that the singer was not actually intoxicated during his arrest, and that law enforcement made a mistake by detaining him.
The singer reportedly told the officer he had one martini and was following some friends home, but he arrested and later charged with a driving-while-intoxicated misdemeanor.
The lawyer also claimed that there was an issue with the police’s paperwork, which led attorney Carl Irace to order the singer to be re-arraigned.
He said: "Justin should not have been arrested for driving while intoxicated. The police made a number of very significant errors in this case.
"You heard the DA try to fix one of those errors, but that's just one, and there are many others. Sometimes the police, like every one of us, make mistakes. And that's the case in this very instance."
Timberlake's allegedly intoxicated condition was detailed in court papers, which read: "His eyes were bloodshot and glassy, a strong odor of an alcoholic beverage was emanating from his breath, he was unable to divide attention, he had slowed speech, he was unsteady afoot and he performed poorly on all standardized field sobriety tests."
At 12:37 a.m., cops placed Timberlake under arrest and he was taken to police headquarters where he was processed and booked.
Cops say "the alcohol influence report was read in its entirety to [him] at [12:52 a.m.], to which [Timberlake] responded, 'No, I'm not doing a chemical test.'
"The alcohol influence report was read in its entirety a second time at [1:07 a.m.], to which [Timberlake] responded, 'I refuse.' The alcohol influence report was read in its entirety a third time [at 1:22 a.m.], to which [Timberlake] responded, 'I refuse.'"
Cops also noted that Timberlake made the following admission: "I had one martini and I followed my friends home."
Hours later, Timberlake was spotted leaving, getting into a black vehicle.
