Kim Zolciak and Kroy Biermann's Divorce Takes Dramatic Turn as He Files for Sole Custody of Their Four Kids


Kim Zolciak’s estranged husband, Kroy Biermann, has once again requested sole custody of the pair’s four minor children over the reality star’s alleged “mismanagement of basic parenting responsibilities.”



Former Real Housewives Of Atlanta star Kim Zolciak's contentious divorce battle took a new turn on Monday when her ex, Kroy Biermann, filed a motion in court for sole custody of their four minor children.


According to court documents obtained by the Daily Mail, the 40-year-old retired NFL player asked a Georgia state judge to transfer custody to him because Zolciak had allegedly been flouting her parental responsibilities.


Biermann accused the 47-year-old reality star, with whom he currently has joint custody, of 'blatant mismanagement of basic parenting responsibilities [that] would be practically unbelievable to anyone not familiar with the circumstances.'


Zolciak blasted the claims in a statement to the Daily Mail, with her spokesman saying: 'These accusations are completely false' and alleged the filing is 'nothing more than a deliberate attempt by Kroy to defame my character.'


'I spent five weeks away working on two TV shows to support my family and make sure my children are cared for - something I will never apologize for.


'I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent , the truth is on my side, and it will come to light - no matter how hard anyone tries to bury it.'


The Daily Mail has also reached out to representatives for Biermann to request comment and has yet to hear back.


The latest development in Zolciak and Biermann's ugly divorce battle comes after the two sat for a mediation session on January 27 to sort out their temporary child custody agreement.


The exes share four minor children: sons KJ, 14; Kash, 13; and Kane, 12; as well as Kane's twin sister, Kaia.




Zolciak also has two adult daughters from previous relationships — Brielle, 29, and Ariana, 24 — both of whom Biermann later adopted.


In his latest filing, Biermann claimed that his ex had been traveling extensively out of the country and had failed to parent their children on their agreed-upon dates from February 26 through March 29 of this year.


He alleged that the only exception during that period was when Zolciak exercised her parenting time on the night of March 9, at which point one of their 'minor children was subject to a dog bite.'


Biermann additionally alleged that Zolciak had entered into their temporary mediated parenting plan 'in bad faith, knowing at the time of agreement that she could not and in fact did not intend to adhere to the terms of agreement.'


He also accused her of 'fraud and deceit' for pushing for the temporary agreement, which gave them joint custody.



The former athlete alleged that, when Zolciak was in the country and parenting on her assigned days, she had allowed their children to miss their scheduled therapy sessions.


On top of that, Bierman claimed his ex had failed to meet with her own therapist for the minimum required number of sessions, and he accused her of 'lying to the therapists.'


'Respondent's continued noncompliance with the Safety Plan directly jeopardizes the safety and well-being of the minor children and renders the current Temporary Mediated Parenting Plan unworkable and contrary to the children's best interests,' his filing read.


Biermann claimed that he was ready to show, 'through expert and witness testimony,' that Zolciak is 'both unstable and unfit as a custodial parent,' and therefore he asked the court to immediately award him sole custody of their children.


The couple has been separated since 2023 and has been in a lengthy divorce battle ever since August of that year.


Biermann filed for divorce in May 2023, with Zolciak doing the same shortly thereafter.


The following July, they briefly reconciled before Biermann filed for divorce again in August 2024, and then again in early 2025.



Biermann had previously requested sole custody in August of last year.


He accused his estranged wife of neglect, as well as 'emotional and psychological abuse,' and petitioned the court to have sole custody due to the 'noteworthy absence of structure and accountability' in his ex's home.


Previously, they were on a split-custody arrangement, with each parent having two children at all times with a week-by-week exchange, which they agreed to after they were forced to move out of their foreclosed Georgia mansion in April 2025.


In June of last year, Zolciak publicly accused Biermann of 'not providing' for their kids during an appearance on Kristin Cavallari's Let's Be Honest podcast tour.


She also previously sought sole custody of their four minor children.


While speaking with her fellow reality star, Zolciak claimed Biermann was financially unfit to provide for their children and had not paid their bills 'in years.'


'I've worked my a** off to provide for my family and my children,' Zolciak said.


'This man has not paid a bill in this house in years. Even with a job, he hasn't paid a bill in this house in years. Not clothes for my children, not extracurricular [activities], nothing.'
