Kim Zolciak’s Son K.J. Biermann, 15, Pleads Not Guilty to 7 Felony Charges Amid Sexual Assault Case

The Real Housewives of Atlanta star Kim Zolciak’s son, Kroy “K.J.” Biermann Jr., has pleaded not guilty to all seven felony counts in his ongoing sexual assault case.
Entertainment Weekly can confirm that K.J.’s attorney, Jason Sheffield, filed the document, including K.J.’s not guilty plea, in Georgia’s Fulton County Superior Court on Monday. Page Six was first to report the news, revealing that K.J. has also waived his right to a formal arraignment, set for Oct. 14.
Sheffield also asked for 10 days in between receiving discovery and filing motions in the case. He also asked for a hearing date to discuss transferring the case to juvenile court, per the Page Six report. The Georgia judge also reportedly sealed three “envelopes” related to the case.
Sheffield previously revealed K.J.’s intention to enter a not guilty plea in a statement to Page Six on Sept. 9. At the time, multiple outlets reported that Sheffield had filed a motion asking the court to move K.J.’s case to juvenile court.

K.J. was taken into police custody on Aug. 17, after being accused of sexual assault, following an incident that took place this past April at a Life Time Fitness, located in Alpharetta, Ga. A police report obtained by EW at the time stated that K.J. had allegedly attempted to force himself on a female victim, who claimed she said “no” multiple times.
Weeks later, K.J. was indicted on charges of aggravated child molestation, aggravated sexual battery, aggravated sodomy and false imprisonment, along with three counts of sexual battery against a child under the age of 16.
“I respect the difficult responsibilities carried by prosecutors and victim advocates,” K.J’s attorney, Sheffield, told EW in a statement following his client’s indictment. “Cases involving children require patience, care, and a commitment from all of us to understanding the full picture as the process continues.”
K.J. is the eldest son of Zolciak and estranged husband Kroy Biermann. They are also the parents to Kash, 13, and 12-year-old twins Kaia and Kane. Zolciak is also the mother to adult daughters Brielle, 29, and Ariana, 24.
During a Sept. 11 bond hearing, Georgia prosecutors also accused K.J. of having sex with an underage relative. The Fulton County Deputy District Attorney claimed at the time that investigators had previously discovered “multiple encounters” of K.J. depicting him having sex with a family member under the age of 12, and allegedly using “predatory, derogatory” language. The DDA claimed that K.J. had been under court supervision in connection with those allegations since October 2025.
Sheffield told EW at the time that “the characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case.”
He added: “The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense. Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”
