KJ Biermann, 15, Released from Jail After Sodomy, Sexual Battery Arrest

Kroy Biermann Jr. has been released from jail and is now living with his mom and former Bravo star, Kim Zolciak. According to TMZ, sources confirmed KJ was released within the last several days.

Kroy “KJ” Biermann Jr. has been released from jail following a near-month long stint behind bars amid his sexual battery case.

KJ, 15, was released this week and is living with his mom, Kim Zolciak, TMZ reported.

The teen was granted $200,000 bond by Fulton County Superior Court Judge Melynee Leftridge, whose ruling came down Friday after a contentious bond hearing that saw unsettling new allegations against KJ.

KJ’s release on bond from Atlanta’s Metro Regional Youth Detention Center also came with strict rules from the judge, including a stipulation that he must stay at of his mother Kim Zolciak’s house and attend school virtually, according to court docs obtained by Page Six.

He must also abstain from social media of any kind and cannot use a cellphone. Additionally, KJ is barred from having direct or indirect contact with the victim — or her family or associates — and he cannot have contact with anyone aged 16 or under.

At the bond hearing, KJ’s attorney, Jason Sheffield, and Deputy District Attorney Caitlin McGillicuddy argued for what the teen’s bond should be set at — with the former pushing for $65,000 and the latter urging for $190,000.

Sheffield argued that KJ is “not a boisterous kid” and is “somewhat quiet,” noting that Zolciak would be able to keep an eye on him as the “Real Housewives of Atlanta” alum is not currently employed.

McGillicuddy cited the “documented physical injury” of the victim in what she labeled the “predatory” sexual battery and sodomy case — which KJ was initially arrested for on Aug. 17.

Following his arrest, KJ was officially indicted by a grand jury in Georgia on seven charges — including aggravated child molestation, aggravated sodomy, aggravated sexual battery, false imprisonment and three counts of aggravated sexual battery against a child under 16 — on Sept. 3.

Those charges stemmed from an incident with a female classmate in the co-ed sauna at the Life Time fitness center in Alpharetta, Georgia, on April 23, according to court documents obtained by Page Six.

The alleged victim was examined the following day at the North Fulton hospital in Georgia, with no evidence of male DNA found in her mouth or vagina, per the police report.

Sheffield has maintained that KJ is “100% innocent” of the claims and Zolciak has defended her son against what she called “reckless and deeply troubling” allegations.

A victim statement read aloud in court asked the judge to “consider [her] safety” when deciding whether to release KJ on bond, noting that she’s been “living in fear” over alleged threats that he would come after her or her loved ones if he was released.

“No matter who these threats came from directly, I cannot just ignore them or assume that nothing will happen,” she wrote in the statement. “I am not only scared for myself anymore; I am scared for my family, too. Members of my family have received emails and phone calls because of this situation.”

“The thought of him being released scares me more than I can put into words,” the statement went on.

Meanwhile, Sheffield noted that his client’s imprisonment and the allegations against him have been “so traumatizing to [KJ] personally.”

Things took a dramatic turn during Friday’s hearing, as McGillicuddy made the bombshell claim that investigators had discovered videos on KJ’s phone allegedly depicting him having penetrative sex with a family member under the age of 12.

McGillicuddy claimed there are “multiple encounters” on video discovered on the cellular device and they allegedly show KJ using “predatory, derogatory” language toward the victim.

“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims,” McGillicuddy noted, adding that KJ was previously charged with sexual battery of a victim under the age of 16, which had not been publicly reported until now.

Per McGillicuddy, KJ had been under court supervision since October 2025 following the alleged incident with the family member, which she said was reported in April 2023.

Sheffield defended his client against the new allegations in a statement to Page Six released after the hearing.

“The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case,” he began.

“The matter arose from inappropriate, crude behavior involving two middle-schoolers,” Sheffield continued. “It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense.”

He added, “Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”

Sheffield has requested KJ be be transferred to juvenile court instead of being tried as an adult, which he said could see the teen potentially sentenced to, as Page Six exclusively reported, “25 years in prison, up to life.”
