Gay adult performer Justin Heath Smith, known as Austin Wolf, was scheduled to appear in Manhattan federal court on Monday (9/29) for sentencing after pleading guilty to enticing a minor.
In a September 22 memo, prosecutors urged Judge Paul A. Engelmayer to impose up to 19.5 years, calling Smith’s conduct “unusually egregious” and warning he remains a danger to the public. His defense team countered in a September 16 filing, followed by a reply brief on September 25, urging the court to impose only the 10-year minimum. They argued that prosecutors inflated the case with unproven allegations and said Smith has made strides in rehabilitation while in custody. PRIDE has learned that the hearing is ongoing, according to a spokesperson for the U.S. Attorney's Office for the Southern District of New York.
I will have updates for you as they come down the pipeline.
